BY SIGNING UP FOR OUR SERVICE OR BY SIGNING OUR SERVICE ORDER, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT AND ALL TERMS AND CONDITIONS INCORPORATED BY REFERENCE IN THIS AGREEMENT, INCLUDING BUT NOT LIMITED TO, ThunderSteed's PRIVACY POLICY. YOUR USE OF THE SERVICES ALSO CONSTITUTES ACCEPTANCE OF THIS AGREEMENT.
This Agreement is entered into on the date the registration is completed, (the "Effective Date") by and between Customer ("Customer") and ThunderSteed. Customer and ThunderSteed are sometimes referred to collectively in this Agreement as the "Parties". Customer desires to engage ThunderSteed for the purpose of providing services to Customer.
To carry out these purposes, the Parties have agreed to the definitions below.
By using the Services, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you may not use the Services.
The Services are only available to individuals and entities who are at least 18 years of age and who can form legally binding contracts.
The Company provides a variety of services, including:
The specific services that are available to you will depend on your subscription plan.
The Company charges fees for the Services. The fees for your subscription plan will be specified in your subscription agreement.
You must pay the fees for your subscription plan in advance. The Company accepts payment by credit card or PayPal.
Either party may terminate these Terms and Conditions at any time. If you terminate these Terms and Conditions, you will no longer be able to use the Services.
The Company may terminate these Terms and Conditions if you breach any of the terms of these Terms and Conditions.
The Company owns all intellectual property rights in the Services. You may not use the Services in any way that infringes on the Company's intellectual property rights.
If you submit any content to the Services, you grant the Company a non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media.
The Company reserves the right to remove any content from the Services that it deems to be inappropriate or in violation of these Terms and Conditions.The Services are provided on an "as is" basis. The Company makes no warranties, express or implied, about the Services.
The Company will not be liable for any damages arising out of or in connection with your use of the Services, including, but not limited to, direct, indirect, incidental, consequential, or punitive damages
These Terms and Conditions will be governed by and construed in accordance with the laws of the State of Virginia.
These Terms and Conditions constitute the entire agreement between you and the Company regarding the Services. These Terms and Conditions supersede any prior or contemporaneous communications, representations, or agreements, whether oral or written.
INF any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision will be struck from these Terms and Conditions, and the remaining provisions will remain in full force and effect.
The Company may change these Terms and Conditions at any time. The most current version of these Terms and Conditions will be posted on the Company's website.
